Judge Delivers Massive Blow to Vaxx Mandates for NY City Workers

Covid-19 vaccine mandates in New York City were struck down in court amid controversies against New York Mayor Eric Adam’s night-life party lifestyle despite the pandemic crisis. 

The NYC state judge has recently struck down the covid-19 vaccine mandates for city workers and reinstated 16 sanitation workers who got fired for not complying with the vaccination mandate issued in October 2021, deciding they should also get back pay.

“So my name’s Chad Laveglia. I’m an attorney who gets to represent these fine men and women over here. What just happened was the judge found that the city’s vaccine mandate is unconstitutional. Violates separation of powers… found it to be arbitrary and capricious. He found the commissioner’s order mandating private and public employees to get vaccinated was arbitrary and capricious and it’s null-and-void essentially,” the Attorney, handing the case, said in an interview with NYC for Yourself. 

Attorney Laveglia also declared that “we just defeated the vaccine mandate for every single city employee, not just sanitation, FDNY, NYPD, Department of Corrections. For all the brave men and women who have been our first responders and have been brave through all this. You’re now free and you should be able to go back to work.”

According to the reports, the DSNY workers brought the case to the court after being terminated for failing to comply with the mandate.

Richmond County Supreme Court, Judge Porzio reportedly ruled against the city around 2:30 p.m., praising workers and declaring the mandate arbitrary and capricious.

In a ruling on Monday, Judge Porzio wrote that “there is nothing in the record to support the rationality of keeping a vaccination mandate for public employees, while vacating the mandate for private sector employees or creating a carveout for certain professions, like athletes, artists and performers. This is clearly an arbitrary and capricious action because we are dealing with identical unvaccinated people being treated differently by the same administrative agency.”

“We have learned through the course of the pandemic that the vaccine against Covid-19 is not absolute. Breakthrough cases occur, even for those who have been vaccinated against Covid-19 is not absolute. President Joseph Biden has said that the pandemic is over. The State of New York ended the Covid-19 state of emergency over a month ago,” Judge Porzio added.

Following Porzio’s statement, a spokesman with the law department released an official statement and claimed that “the city strongly disagrees with this ruling as the mandate is firmly grounded in law and is critical to New Yorkers’ public health. We have already filed an appeal. In the meantime, the mandate remains in place as this ruling pertains solely to the individual petitioners in this case. We continue to review the court’s decision, which conflicts with numerous other rulings already upholding the mandate.”
