A judge in Illinois said that former President Donald Trump will not be on their primary election vote because he is still being tried for his part in the Capitol Riot.

Because of his part in the January 6 Capitol Riot, Tracie Porter, a Cook County Circuit Judge in Illinois, said that Donald Trump would not be on the state ticket. But the judge recently put off making a decision until they hear Donald Trump’s appeal.

Porter agreed with people who said Donald Trump shouldn’t be able to run for president and should be taken off of both votes (the primary and the general election). He was taken off the vote because he broke the “anti-insurrection clause” of the 14th Amendment.

The section says someone has broken the law if they swear to support the United States and then “engages in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.” A group of Trump fans were told to go to the Capitol Building on January 6 to watch the transfer of Joe Biden’s presidency.

This led to a riot in which police and civilians were hurt. A case is still going on to find out what role Trump and his fans played in this. States have to decide if they want to put Trump’s name on their primary ballots because of his beliefs.

As part of its review of Donald Trump’s eligibility to run for office, the Supreme Court will decide the outcome of this decision and other similar ones. Other states, like Maine and Colorado, also decided not to print Donald Trump’s name on their ballots, but those choices will also be put on hold until Trump files an appeal.
